Club Member Terms & Conditions
Member agrees to treat attendees of One-OneThousand events and other members with respect, adhere to safety rules, and follow instructions from One-OneThousand, and act in accordance with the One-OneThousand Member Code of Conduct.
TERMINATION OF MEMBERSHIP.
One-OneThousand reserves the right to terminate any individual or company’s status as Member at any time if Member, through their actions, representations, behavior, or communications is deemed to be injurious to One-OneThousand’s events, services, image, or objectives. Termination of membership terminates any and all responsibility of One-OneThousand to fulfill obligations set forth in the Membership Agreement.
No membership or right arising from membership is transferable unless such transfer is agreed to in writing by the Company. All membership rights cease on the member’s death or incapacity.
MEMBERSHIP REFUND POLICY.
One-OneThousand reserves the right to deny any and all requests for full or partial Membership refunds for any reason. One-OneThousand will not issue refunds of Membership fees that result from Member’s breach of the membership duties or voluntary cancellation of membership. Acceptance of membership constitutes a contract between One-OneThousand and Member. One-OneThousand reserves the right to enforce the obligations contained in this Membership Agreement.
THIRD PARTY PAYMENT SERVICE.
The collection of membership fees is subject to the terms and conditions provided by the third-party payment services vendor. One-OneThousand accepts no responsibility for any defect, breach of privacy, inaccuracy, or other injury that results from the third-party vendor. One-OneThousand accepts no responsibility for any overdraft fees or other penalties or charges that may result from the use of the auto-payment system.
Given the public nature of One-OneThousand Events, One-OneThousand cannot and does not guarantee the privacy of members at One-OneThousand Events. Under state law, Member should have no expectation of privacy regarding their image in public spaces. One-OneThousand reserves the right to document events and publish images on social media. By signing this Membership Agreement, Member agrees and acknowledges that One-OneThousand may use Member’s image or likeness for promotional or publicity purposes.
ONE-ONETHOUSAND IS NOT LIABLE FOR ANY DAMAGES THAT RESULT FROM THE ACTION OR NEGLIGENCE OF MEMBERS, THRID PARTIES, VENUES, VENUE EMPLOYEES, PROMOTED PRODUCTS, ATTENDEES OR ONE-ONETHOUSAND REPRESENTATIVES. Many One-OneThousand events are open to the public and One-OneThousand accepts no responsibility or liability for the actions of Members, Attendees, or other parties present. MEMBERS EXPRESSLY ASSUME ALL RISKS INCIDENT TO ONE-ONETHOUSAND EVENTS, WHETHER OCCURRING PRIOR TO, DURING, OR SUBSEQUENT TO THE ACTUAL EVENT AND AGREE THAT ONE-ONETHOUSAND AND ITS EMPLOYEES ARE HEREBY RELEASED FROM ANY AND ALL CLAIMS ARISING FROM THE EVENT, INCLUDING CLAIMS OF NEGLIGENCE. Consistent with Wisconsin common law, Member retains the right to pursue claims against One- OneThousand for reckless or intentional conduct.
LIMITATIONS OF LIABILITY AND DISCLSIMERS WILL SURVIVE TERMINATION OF THE MEMBERSHIP AGREEMENT. Member may be required to sign additional liability waivers in order to participate in specific One-OneThousand Events. Such additional liability waivers will not overrule or suspend Section XIII of the Membership Agreement.
One-OneThousand reserves the right to change and update the Terms and Conditions stated at One-OneThousand.net and the One-OneThousand Member Code of Conduct at any time. Continued use of One-OneThousand services signifies your acceptance of any new or updated terms or conditions and the One-OneThousand Member Code of Conduct.
Member hereby agrees that he/she has read, understood, asked any pertinent questions, and agreed to the One-OneThousand.net terms of service and that violation of the terms of service may result in termination of membership.
This Membership Agreement is governed by Wisconsin law.
Membership with One-OneThousand entitles the Member to the rights and privileges described in this Membership Agreement. This Membership Agreement does not constitute the formation of a joint venture or partnership between the Member and One-OneThousand or any other member. This Membership Agreement does not entitle Member to any equity ownership in One-OneThousand or in any other member.
Supplementary Agreements between Member and Company, including but not limited to joint venture partnerships, employment or independent contractor agreements and purchase agreements, will not supersede or replace this Membership Agreement with respect to provisions addressed herein.
